Purchase Agreement
By accepting delivery of any product ordered from Action Training Systems, you ("Customer") agree to be bound by the terms and conditions listed below. You and Action Training Systems agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and Action Training Systems. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice. Therefore, please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from Action Training Systems (action-training.com).

Satisfaction Guarantee/Refund Policy
All merchandise unless otherwise indicated may be returned within 30 days from the original invoice date for a refund. A 15% restocking fee may apply. These terms apply to all refunds. Customers must inform Action Training Systems of any order discrepancy within 7 days from the invoice date so that we may investigate and resolve the situation accordingly. 

To take advantage of Action Training Systems satisfaction guarantee, the Customer must comply with the Product Return Procedure detailed below. Any breach of Action Training Systems Return Policy Procedure will result in the loss of Action Training Systems refund/replacement guarantee. Furthermore, all return shipments not in compliance with these instructions will be rejected

Product Return Procedure
To return a product in compliance with Action Training Systems satisfaction guarantee, you must obtain a Return Merchandise Authorization within the guarantee return period for the product (described above). Please call 1-800-755-1440 ext 3 to acquire an RMA. Action Training Systems will not accept returns without prior authorization. Once issued, RMA numbers are valid for 15 days within which return products must be received by Action Training Systems. RMA numbers will not be extended or reissued. Customer should prominently display the RMA number(s) on the shipping label of boxes containing the returned product. 

Customer is solely responsible for shipping any returned product to Action Training Systems. Customer agrees to use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment. Customer agrees to bear all shipping and insurance charges and all risk of loss for the return product during shipment. Customer agrees that all returned products will be 100% complete, in re-saleable condition, and will include the original packaging material, manuals, blank warranty cards, and other accessories provided by the manufacturer. If any component of the returned product is missing, Action Training Systems Return Procedure will be breached and Action Training Systems may in its sole and absolute discretion reject the entire return or choose to impose additional charges against the customer for replacement of the missing component(s). 

Our Bullet-Proof Replacement Warranty
Free replacement for 5 years from the date of purchase – period!  Defective, scratched, crushed, melted –even if is your fault – send us the pieces and we will send you a free replacement.  This warranty covers all product produced by Action Training Systems (does not cover loss of product)

Shipping Charges
Your total cost for purchase of any product will include the shipping and handling charges shown on your Action Training Systems invoice. However, your original shipping fees are non-refundable in the case of a returned product. Those fees are paid for the services provided by and to the original carrier, and will not be refunded to you if your item is returned for a refund to Action Training Systems.

Limitation of Liability
IN ALL CIRCUMSTANCES ACTION TRAINING SYSTEMS MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. ACTION TRAINING SYSTEMS SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. ACTION TRAINING SYSTEMS SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT ACTION TRAINING SYSTEMS HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES. 

Order status

Action Training Systems will keep you informed of your order status via phone and e-mail. You may also acquire your order status and other live updates by calling 1-800-755-1440 ext 3. 

Fair Credit Billing Act: Under the Fair Credit Billing Act, your bank cannot hold you liable for more than $50.00 for fraudulent charges. In the event of unauthorized use of your credit card, you must notify your credit card provider in accordance with its reporting rules and procedures. 

Change Orders
You may request a change to your order provided the order has not already been charged to your account. Please call 1-800-755-1440 ext 3 during Action Training Systems hours of operation to request a change to your order. Please have your sales order (SO) or customer number ready for better assistance. We strongly discourage sending change order requests via email because it is unlikely we will receive the message in time to make an adjustment due to the sheer volume of emails we receive each day.

Cancel Orders
You may request that an order be cancelled provided the order has not already been processed and shipped. Simply call 1-800-755-1440 ext 3 during Action Training Systems hours of operation to request an order cancellation. You will receive a credit for the full amount to your credit/debit card in approximately 1-2 business days. We strongly discourage sending order cancellation requests via email because it is unlikely we will receive the message in time to void the order due to the sheer volume of emails we receive each day.


Privacy Policy
Information Collection and Use
Action Training Systems is the sole owner of information collected on this site. We will not sell, share, or rent this information to any outside parties, except as outlined in this policy. We collect information from our customers to process orders and better serve you with pertinent information, such as order confirmations and order status updates. Information collected includes your name, shipping address, billing address, telephone numbers, e-mail address, and payment information such as your credit card number.
If you elect to receive our catalog or special promotions, your contact information will be used for the delivery of these items. 


Action Training Systems respects your privacy. We will not under any circumstances sell or release your information to anyone except as outlined in our privacy policy. All of the information obtained from our Web site will be used for processing purposes only.

As our business continues to evolve, we may acquire or sell business units or subsidiaries. Customer information is one of the business assets that would be transferred in these types of transactions. In such a situation, your personally identifiable information would only be used in a manner consistent with our pre-existing Privacy Notice. 

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Web site.

Registration
In order to process your orders placed on this website, you must first complete the registration form. During registration, you will be required to provide your contact information, which includes your name, e-mail address, telephone number and street address. This information is used to provide you with important Action Training System services such as order status updates via phone and e-mail.

 

Order
Most of the information collected in the registration process will be used to process orders. During the order process, you will have to provide financial information such as your credit card number and expiration date. This information is used for billing purposes and to fulfill your order. If we have trouble processing an order, we will use this contact information to get in touch with you. To properly process your credit card information, we must share your personal and financial information with the merchant bank for authorization and approval. This process is protected by an enhanced security system. See the Security section below for more details on security measures and procedures. We do not share your personal and financial information with any third parties, except those specified in the Sharing section of this policy. 

Log Files
We use IP addresses to analyze trends, administer the site, track user movement, and gather broad demographic information for aggregate use. We do not link IP addresses to personally identifiable information, and we do not distribute or share IP information with any third parties. 

Sharing

Delivery Policy
Processing Time
You can expect your order to be processed within approximately 24-48 hours, provided the items are in stock and there are no problems with payment verification. Action Training Systems does not guarantee same day-shipping. Orders are not processed on weekends and holidays. 

Shipping Methods

  • UPS Ground - 5 to 7 business days + 24-48 hours to process the order.
  • UPS 3Day - 3 business days + 24-48 hours to process the order.
  • UPS 2Day - 2 business days + 24-48 hours to process the order.
  • UPS Next Day - Delivery within 1 business day + 24-48 hours to process the order.
  • USPS - APO/FPO orders welcome! Delivery will take approximately 2 to 6 weeks + 24-48 hours to process the order.
  • For Hawaii and Alaska customers, UPS can only ship via 2Day Air and the shipping time will not be guaranteed.
  • All orders require 24-48 hours processing time before shipping.
  • Action Training Systems does not process orders during weekends.
  • No deliveries will be made on Saturday or Sunday.
  • Action Training Systems does not guarantee same day shipping.
  • All orders shipped within Washington will be charged state sales tax.

General Terms and Conditions 

Orders
An order is not binding upon Action Training Systems until it is accepted; Action Training Systems must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card, or some other method prearranged with action-training.com. You agree to pay the amount(s) due as specified on the invoice, and you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.

Governing Law and Jurisdiction
Any dispute arising out of or related to these Terms and Conditions or the sales transaction between Action Training Systems and Customer shall be governed by the laws of the State of Washington, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. Action Training Systems and Customer consent to the exclusive jurisdiction and the exclusive venue of the State Courts of the State of Washington, Kitsap County, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against Action Training Systems that is more than one year after the date of the applicable invoice. 

Severability
If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Washington law. 

Waiver
The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing. 

Entire Agreement
These terms and conditions, together with Action Training Systems invoice regarding the products ordered by Customer, are the complete and exclusive agreement between Action Training Systems and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between Action Training Systems and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage. 

Notification of Changes
If we decide to change our Privacy Policy, we will post those changes to this privacy statement and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We reserve the right to modify this privacy statement at any time, so please review it frequently.
